This privacy notice is applicable for the processing of personal data for the recruitment purposes via https://fusion.ap-tech.pl/

Below, you will find detailed information about the processing of your personal data in the recruitment process conducted by AP-TECH LIMITED LIABILITY COMPANY (in Polish: AP-TECH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ) for our external clients. This privacy notice provides information to the data subject whose data is being processed, in accordance with Article 13 of the General Data Protection Regulation (GDPR). Additionally, AP-TECH has implemented a policy dedicated to the security of the processing of personal data in accordance with Article 24(1) of the GDPR.

1. Data Controller

The Data Controller of your personal data is AP-TECH LIMITED LIABILITY COMPANY (in Polish: AP-TECH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ) registered in the National Court Register (KRS in Polish) under the number 0000548754 (hereinafter: „AP-TECH”). 2. Data Protection Officer

A data protection officer has been appointed at AP-TECH. This person is the point of contact for all matters related to the processing of personal data and exercising rights related to data processing. 3. Purposes of processing your personal data and the legal basis for processing

AP-TECH will be processing your personal data for the recruitment processes, which we are conducting for our external clients.

In relation to recruitment, your personal data will be processed for the following purposes:

• Assessing your qualifications for the position you are applying for.
• Evaluating your skills and abilities required for the position you are applying for.
• Selecting the appropriate candidate for specific recruitment process.

With your separate consent, we will also process your data for future recruitment processes.

The legal basis for processing your personal data is as follows:

• In the case of an employment contract: legal provision (Article 221 § 1 of the Polish Labour Code) related to the processing necessary for the conclusion of an employment contract – regarding the following data: name and surname, date of birth, contact details, education, professional qualifications, employment history. If you provide additional data beyond the mentioned ones, such as in your CV and cover letter, your consent is required for processing this data for recruitment purposes.
• In the case of another than employment contract: regarding the following data: name and surname, date of birth, contact details, education, professional qualifications, employment history – this data is processed based on your consent for recruitment purposes.
• Necessity of processing for the conclusion of an employment contract or cooperation agreement.
• Our legitimate interest – regarding the data collected during the job interview. We have a legitimate interest in assessing your skills and abilities to determine if you are suitable for the position we are recruiting for, what is not infringing upon your rights or freedoms and – regarding IP address is it necessary for monitoring the security of our website, what does not infringing upon your rights or freedoms.
• Your consent to the processing of data for future recruitment purposes.

4. Data retention

At AP-TECH, we will retain your personal data until the completion of the recruitment process for the position you are applying for. If you have provided separate consent for the processing of data for future recruitment purposes, we will retain your data for a period of 2 years from the date of your consent.

5. Data recipients

Your personal data may be disclosed to our clients in Poland, for whom we are providing recruitment services.

6. Your rights

You have the following rights related to the processing of your personal data:

• The right to access your personal data.
• The right to request the rectification of your personal data.
• The right to request the erasure of your personal data.
• The right to request the restriction of the processing of your personal data.

Right to withdraw consent

To the extent that your data is processed based on your consent, you have the right to withdraw your consent for data processing at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Right to object

As your data is processed by AP-TECH based on legitimate interests, you have the right to object to the processing of your data due to your particular situation.

Right to lodge a complaint with a supervisory authority

You also have the right to lodge a complaint with the supervisory authority responsible for data protection, which is the President of the Personal Data Protection Office.

7. LinkedIN and other platforms

In relations of communication taken via platforms (e.g. LinkedIn) additionally privacy policy of specific platform is applicable to the processing of your personal data.
